Introduction
Current and forthcoming legislation increasingly place responsibility on all managers to ensure they deal fairly with disciplinary issues, following clear and appropriate procedures and acting within the precepts of best practice. This one-day programme is a focussed excerpt from the wider MaSh programme "Employment Law" and is designed to give managers the knowledge, skills and confidence they need to apply their organisation's disciplinary procedures.

Learning Outcomes
On successful completion of this programme, participants will be able to:

  • Explain the main points of the law relating to disciplinary procedures and practice
  • Describe the specific disciplinary procedures within their own organisation
  • Describe the rights of employees and responsibilities of employers
  • Define the responsibility of the line manager and the responsibility of the HR function
  • Run a disciplinary procedure
  • Conduct a disciplinary interview
  • Recognise when and how to seek specialist advice

Programme Content
The programme challenges participants to consider why, when and how people under-perform and ultimately what counts as a disciplinary issue. The content covers a strong element of the legal implications and in particular the issue of unfair and constructive dismissal. Participant practice includes managing the disciplinary procedure from start to finish and running the actual interview
